  • When is guardianship necessary?

    Guardianship is necessary when someone has been determined to no longer be able to handle their own affairs. In some instances, those individuals may have executed a power of attorney and healthcare surrogate prior to becoming incapacitated. If those documents have already been executed, many times, a guardianship is not necessary. However, when a power of attorney and healthcare surrogate have not been executed, someone must be named to help the alleged incapacitated person with their financial and healthcare decisions. This is when guardianship comes into play.
